Gaggi Group is a team of salespersons and brokers at Best Sellers Realty Inc., Brokerage. Best Sellers Realty Inc., Brokerage (“we,” “us,” or “our”) is a real estate brokerage registered with the Real Estate Council of Ontario (RECO). We respect your privacy and handle personal information in line with the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's Anti-Spam Legislation (CASL), and the Trust in Real Estate Services Act, 2002 (TRESA).
This policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, and the choices you have. It applies to gaggigroup.com and to the real estate services provided by our brokerage and its salespersons and brokers.
We are responsible for the personal information we hold, including information our service providers handle for us. Our Broker of Record is our Privacy Officer and is accountable for our compliance with this policy. You can reach our Privacy Officer using the contact details at the end of this policy.
We collect only what you choose to send us:
• Contact and enquiry forms (general, property, agent, office and presentation enquiries): your name, email address, phone number and message
• Newsletter and pop-up sign-ups: your email address, and your name where asked
• Saved searches and listing alerts: your name, email address, search criteria (such as area, property type, price range, bedrooms and bathrooms) and how often you want alerts
• Listing access registration: your name, email address and phone number, if we ask you to register to view full listing details. You sign back in with a one-time code we email to you.
• Career enquiries: your name, contact details and anything you tell us about your background
• Home valuation requests: the property details and contact information you enter in our home valuation tool
Please don't send sensitive information, such as financial or identity details, through website forms. If you become a client, we will collect what we need through a secure channel.
• Signing in with Google or Facebook: if you choose to sign in this way, Google or Facebook shares your name and email address with us and confirms the address is yours. We keep the account number they give us so you can sign in again. We never see your Google or Facebook password, and we never post anything for you.
• Sold and leased listings account: your name, email address, phone number and password, the version of our Terms of Use you accepted, and when and from which internet (IP) address you accepted them. We store your password only in a scrambled form that can’t be read back. Every 90 days we ask you to confirm your account with a code we email to you.
• Saved homes: the listings you save with the heart while signed in, kept with your account so you can find them again; our agents can see them to help you.
When you buy, sell or lease through us, we collect the information we need to represent you and complete the transaction. This may include:
• Your name, address and contact details
• Identity verification information, such as your date of birth, occupation and the details of a government-issued photo ID. Federal anti-money-laundering law requires us to collect this and report certain transactions to FINTRAC.
• Property details, and the terms of any agreement, offer or transaction
• Financial information needed for the transaction, such as a mortgage pre-approval or deposit details
We may also receive information about you from others involved in your transaction, such as cooperating brokerages, lawyers and lenders, and from MLS® systems and public property records.
• Website statistics. We count visits with our own analytics, not Google Analytics or advertising trackers. For each page view we record the page, the website that referred you, and your browser and device type. Unique visitors are counted with a one-way code that changes every day. This tool doesn't store your IP address and doesn't build a profile of you.
• Form security. When you submit a form, we record your IP address. We use it to prevent spam and abuse, including limiting how many forms can be sent from one address.
• Emails. Our emails may contain a small image and tracked links that tell us whether an email was opened or a link was clicked. We use this only to see whether our messages are useful.
• Shared presentations. If an agent sends you a link to a presentation, such as a market analysis, we record how it is viewed. That includes which slides were viewed and for how long, and whether the contact or download buttons were used. Your agent sees this so they can follow up with you. We don't store your IP address with this information.
• Sold and leased listings. If you have an account to see sold and leased listings, we record the searches you run and the sold and leased listings you open, with the date, time and your internet (IP) address. The real estate board that supplies this data (PropTx) requires this record and may ask us for it if it believes its data has been misused. We keep it for 12 months.
We use very few cookies, and none for advertising or cross-site tracking:
• A sign-in cookie keeps you signed in if you register to view listing details. It expires after 180 days.
• A listing counter kept in your browser tracks how many listings you have viewed. It is used only when listing registration is turned on.
• Two short-term settings stop our welcome animation and sign-up pop-up from appearing more than once. They clear when you close the browser tab.
Content we embed from other companies may set its own cookies, including videos, maps and our home valuation tool (see section 11). You can block or delete cookies in your browser settings. If you do, your listing sign-in won't be remembered.
• Signing in with Google or Facebook sets a cookie that connects your return from their site to your visit. It expires after 10 minutes.
• Creating a sold and leased listings account sets a cookie that holds your place while you wait for the code we email you. It expires after 15 minutes.
• If you tap a heart before signing in, your browser remembers that listing for up to 10 minutes so it can be saved once you sign in.
• To respond to your enquiries and connect you with the right agent
• To provide the real estate services you ask for, including representing you in a transaction
• To send listing alerts, market updates and other information you've agreed to receive
• To verify your identity and meet our obligations under TRESA, FINTRAC rules and other laws
• To keep our website secure and prevent spam, fraud and abuse
• To understand how our website is used so we can improve it
We won't use your personal information for a new purpose without telling you and, where the law requires, asking for your consent.
We collect, use and share personal information with your consent, except where the law allows or requires otherwise.
• Express consent: when you tick a consent box on our website, you agree to be contacted by phone, text message and email about real estate services.
• Implied consent: when you send us a question, you agree to us replying to it.
You can withdraw your consent at any time, subject to legal or contractual limits. If you do, we may not be able to provide some services. For example, we can't act for you in a transaction without the identity information the law requires.
• Every marketing email we send identifies us and includes a way to unsubscribe. You can also reply STOP to any text message, or contact us directly. We act on opt-out requests promptly, and always within 10 business days as CASL requires.
• We send listing alerts only after you confirm your email address using the link we send you. Each alert includes a link to stop it.
• We respect the National Do Not Call List and keep our own internal do-not-call list, except where you have given us express consent to call you.
• Message and data rates may apply to text messages, and message frequency varies.
We do not sell or rent your personal information. We share it only as described below.
• Our salespersons and brokers. Website enquiries go to our brokerage and to the agent responsible for the listing, office, development or agent page you contacted us from.
• People involved in your transaction. With your consent, we share what's needed with cooperating brokerages, lawyers, lenders and mortgage brokers, appraisers, home inspectors and others involved in your transaction.
• MLS® systems and real estate boards. When you list a property with us, its details and photos are published on MLS® systems and real estate websites. Details of the sale may be reported as board rules allow.
• Service providers. Companies that help us run our business and website may handle personal information for us, including website hosting, email delivery and our home valuation tool. They may use it only to provide their services to us, and must protect it.
• Regulators and legal requirements. We may disclose information to RECO, FINTRAC, law enforcement or others where the law requires or permits it, such as during a regulatory inspection or under a court order.
• Business transfers. If our brokerage is sold or merged, personal information may pass to the new owner, who must continue to protect it under this policy.
If you sell with us, your property's details, photos and the other listing information you approve are published publicly, including on MLS® systems and other real estate websites. Once it is published, we can't fully control how others copy or display it.
If you make an offer, we keep your personal information confidential. If a seller chooses to share the contents of offers with other buyers, as TRESA allows, the personal information of the buyers who made those offers is not shared.
Some features of our website load content from other companies. When your browser loads it, that company receives your IP address and basic browser information and handles them under its own privacy policy. These are:
• Google Fonts: the typefaces on our pages
• Google Maps: our maps
• OpenFreeMap and OpenStreetMap: a backup when Google’s maps can’t load
• YouTube (in privacy-enhanced mode) and Vimeo: our videos
• cdnjs and unpkg: networks that deliver the software used to show maps and flags
• ValEquity: our home valuation tool. Information you enter is processed by ValEquity to prepare your estimate, which is emailed to you. It is also shared with us so an agent can follow up.
Links to other websites, such as social media pages, Google Maps directions or a listing’s video or virtual tour, and signing in with Google or Facebook, are governed by those websites’ own privacy policies.
Some of our service providers store or process information outside Canada, including in the United States. Our email delivery provider is one example. While your information is outside Canada, the courts, law enforcement and national security authorities of that country may be able to access it under their laws.
We keep personal information only as long as we need it for the purposes in this policy, or as long as the law requires:
• Transaction records, including agreements and related correspondence: at least six years, as TRESA requires
• Identity verification and other FINTRAC records: at least five years
• Enquiries, sign-ups and saved searches: while we are in touch with you, and up to two years after our last contact, unless you become a client or ask us to delete them sooner
• Website statistics: kept only in a form that doesn't identify you
When we no longer need information, we securely delete it or make it anonymous.
• Website accounts, including saved homes: two years after you last sign in, or sooner if you ask us to delete your account
• The record of sold and leased listings viewed: 12 months
We use safeguards suited to how sensitive the information is. These include:
• Encrypted connections (HTTPS) on our website
• Access limited to the staff and agents who need it, with each agent seeing only their own clients
• Confidentiality obligations for our team and service providers
No system is perfectly secure, but we work to protect your information and review our safeguards regularly.
You can ask us to:
• Tell you what personal information we hold about you, how we've used it and who we've shared it with
• Correct information that is inaccurate or incomplete
• Stop sending you marketing messages
• Delete information we are no longer required to keep
Send your request to our Privacy Officer. We may need to confirm your identity first. We will respond within 30 days, or tell you if we need more time, as the law allows. Access is usually free. If there is a cost, we will tell you before going ahead.
If we can't give you some information, we will explain why. For example, it may include other people's personal information or be legally privileged.
If you ask us to delete your information, we keep a brief record of the request, such as your email address. We use it only to make sure we don't contact you or add you back by mistake.
Your account. If you have an account on our website, you can change your name and phone number, and see, pause or delete your saved searches, under My account.
Deleting your account. To delete your website account, including one you created with Google or Facebook, email our Privacy Officer (section 19) from the address you sign in with, with the subject “Delete my account”. We will delete your account, saved homes and saved searches within 30 days. You can also remove our access in your Google or Facebook account settings. We keep only what the law or the real estate board requires, such as the record described in section 4 until its 12 months are up.
If a security breach involving your personal information creates a real risk of significant harm to you, we will notify you. We will also report it to the Office of the Privacy Commissioner of Canada, as PIPEDA requires.
Our website and services are intended for adults. We do not knowingly collect personal information from anyone under 18.
We may update this policy when our practices or the law change. The date at the top shows when it was last updated. If we make a significant change to how we use personal information, we will post a notice on our website and, where required, ask for your consent.
